In accordance with international sanctions, KYC/AML/CTF regulations, and applicable local laws, participation in the presale is strictly prohibited for individuals or entities located in or associated with certain restricted jurisdictions. These include, but are not limited to: Albania, Belarus, Bosnia and Herzegovina, Central African Republic, China, Congo, Côte d'Ivoire, Cuba, Democratic Republic of Congo, Iran, Iraq, Kosovo, Lebanon, Liberia, Libya, Moldova, Myanmar, North Korea, North Macedonia, Somalia, South Sudan, Syria, United States of America, United States Minor Outlying Islands, Venezuela, Yemen, and Zimbabwe.
These Terms and Conditions govern your participation in the Ethereals Token Presale and the required KYC verification process. By accepting these terms, you agree to be bound by the conditions set forth herein and acknowledge that you have read and accepted the Presale Disclaimer above.
2.1 Accurate Information You agree to provide accurate, current, and complete information during the KYC verification process.
2.2 Third-Party Processing You understand that your personal information will be processed by Blockpass (or any other authorised service provider) for verification purposes, and you consent to such processing.
2.3 Failure to Verify You acknowledge that failure to pass KYC verification may result in your inability to participate in the presale.
2.4 Sanctions and Restricted Jurisdictions You confirm that you are not under any financial, trade, or other sanctions imposed by any relevant authority and are not located in, or accessing the presale from, any restricted jurisdiction listed in the Presale Disclaimer.
3.1 Final and Non-Refundable All purchases of Ethereals tokens during the presale are final and non-refundable.
3.2 No Value Guarantee You understand that the value of Ethereals tokens may fluctuate and there is no guarantee of future value or liquidity.
3.3 Utility Token The $REAL token is designed solely as a utility token for use within the Ethereals ecosystem. It does not confer any rights to ownership, equity, profit-sharing, or governance in Ethereals or its affiliates, unless explicitly stated. It is not structured or marketed as a security or any other regulated financial instrument.
3.4 No Expectation of Profit By purchasing $REAL tokens, you agree that you are doing so primarily to access the features, products, or services offered within the Ethereals ecosystem, and not with the expectation of speculative profit or financial gain.
4.1 Prohibited Jurisdictions You confirm that you are not a citizen or resident of, and are not accessing the presale from, any country where participation in token sales is prohibited or otherwise restricted, including those listed under the Presale Disclaimer.
4.2 Age of Majority You confirm that you are at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher.
4.3 Compliance with Laws You agree that you are responsible for complying with all applicable laws, regulations, and rules in your jurisdiction, including but not limited to tax laws.
5.1 Participation Participation in the referral programme is subject to these Terms and Conditions, as well as any additional terms published by Ethereals.
5.2 Commission Distribution Commissions earned through the referral programme will be distributed according to the schedule and method specified by Ethereals. Ethereals reserves the right to modify, suspend, or terminate the referral programme at any time without prior notice.
6.1 Maximum Extent Permitted by Law To the fullest extent permitted by applicable law, Ethereals, along with its affiliates, directors, officers, employees, and associates, shall not be liable for any loss or damage of any kind—whether direct, indirect, consequential, special, punitive, or otherwise—arising out of or in connection with your participation in the presale, the use or reliance on any related information, or the use of $REAL tokens.
6.2 Assumption of Risk You acknowledge and accept all risks associated with the purchase, holding, and use of $REAL tokens, including market volatility, technological vulnerabilities, regulatory uncertainty, and potential operational challenges.
6.3 No Warranties All information, products, and services are provided "as is" and "as available" without any warranty of any kind, whether express or implied, including, without limitation, warranties of merchantability or fitness for a particular purpose.
6.4 Third-Party Services Ethereals is not responsible for the actions, errors, or omissions of any third parties, including but not limited to exchanges, wallets, or payment providers. You acknowledge and agree that use of any third-party services is at your own risk.
7.1 Jurisdiction These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the jurisdiction in which Ethereals is registered.
7.2 No Conflict with Disclaimer In the event of any inconsistency between these Terms and Conditions and the Presale Disclaimer, the Presale Disclaimer shall prevail to the extent of the inconsistency.

These statements are inherently uncertain and subject to change. Ethereals assumes no obligation to update or revise any such statements, whether as a result of new information, future events, or otherwise.
9.1 General Indemnification You agree to indemnify, defend, and hold harmless Ethereals and its affiliates, directors, officers, employees, and associates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or in connection with:
Your participation in the presale or use of $REAL tokens,
Your violation of these Terms and Conditions or the Presale Disclaimer,
Your violation of any applicable laws, regulations, or third-party rights.
9.2 Notification Ethereals reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defences.
10.1 Responsible for Own Taxes You are solely responsible for determining and fulfilling any tax obligations applicable to your purchase, ownership, use, or disposal of $REAL tokens, including but not limited to withholding, collection, reporting, and remittance to the appropriate tax authorities.
10.2 No Tax Advice Ethereals does not provide tax advice. You are encouraged to seek professional tax advice to ensure compliance with your local tax laws.
11.1 Right to Amend Ethereals may modify or update these Terms and Conditions or the Presale Disclaimer at any time without prior notice. Any changes will be effective immediately upon posting on the official presale website, or upon other written communication to you.
11.2 Continued Use Your continued participation in the presale, or use of $REAL tokens, following any such modifications constitutes your acceptance of the updated Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, that provision shall be deemed severed from these Terms and Conditions, and the remaining provisions shall remain in full force and effect.
These Terms and Conditions, together with the Presale Disclaimer and any other legal notices or terms published by Ethereals, constitute the entire agreement between you and Ethereals concerning the presale of $REAL tokens. They supersede all prior discussions, understandings, and arrangements.
By participating in the Ethereals Token Presale and completing the KYC verification process, you expressly confirm that you have read, understood, and agree to these Terms and Conditions as well as the Presale Disclaimer. You further confirm that you fully and voluntarily accept all associated risks and responsibilities.
If you do not agree to these Terms and Conditions or the Presale Disclaimer, please discontinue your participation and refrain from purchasing any $REAL tokens.
